Mutual Consent Divorce

498A & Matrimonial Criminal Proceedings

Section 498A of the Indian Penal Code or Section 85 of BNS deals with cruelty, harassment and dowry-related abuse by the husband or his relatives. The moment a 498A complaint or FIR is filed, the matter becomes criminal in nature, and the consequences can be serious, including arrest and criminal trial. These cases require strong legal strategy, careful documentation and immediate steps for protection.

Anticipatory Bail in Matrimonial Disputes

When a matrimonial dispute escalates into a criminal complaint, especially under Section 498A IPC/ Section 85 of BNS, Domestic Violence, or other harassment-related allegations, the risk of arrest becomes real. In such situations, the most urgent and essential step is to apply for Anticipatory Bail. Anticipatory Bail ensures that a person is not arrested and can participate in the investigation without fear. It is a preventive legal remedy available under Section 438 CrPC.

Quashing of FIR (Section 482 CrPC — Bombay High Court)
